New guidelines for social housing in SP
Decree defines land use rules and technical parameters for HIS and HMP, while city hall cooperation with notaries improves inspection of real estate transactions
The production of social housing gained important milestones in September 2024. On the 10th, Mayor Ricardo Nunes approved Decree 63,728, which regulates provisions of the Strategic Master Plan (PDE), the Land Parceling, Use and Occupation Law (LPUOS) and the Construction and Building Code (COE).
The decree also defines specific rules for land parceling, use and occupation, as well as building standards for Social Interest Housing (HIS), Popular Market Housing (HMP), Development in Special Zone of Social Interest (EZEIS), among others.
The rule considers technical aspects to guide market productions, maintaining the stimulus brought in the PDE and adding more details on the subject. For example, HIS housing units will have a maximum of one bathroom and one parking space, while HMP units will have a maximum of two bathrooms and one parking space.
The HIS and HMP developments may be located in any area of the city. It is necessary, however, that 80% of its computable area be allocated to HIS or HMP units, respectively. The rest may include HMP or HIS units, for residential or commercial purposes.
Projects located in ZEIS may consist of a building or set of buildings that include a specific proportion of HIS (provided for in the annexes of the decree). The rest of the computable area should be allocated to the HMP typology.
The decree also introduced regulations of a technical nature, such as the maximum number of housing units, occupation parameters by zone of use, building criteria, lot qualifiers and the definition of non-computable areas. Another novelty was the exemption from the payment of the onerous grant for HIS projects or those located in the ZEIS that make maximum use of the utilization coefficient.
Cooperation of the city hall with notary offices
On September 24, the cooperation agreement between the City Hall and the Association of Real Estate Registrars of São Paulo (Arisp) was published in the Official Gazette of São Paulo, which enables the exchange of electronic information on real estate transactions of properties falling into the HIS and HMP categories.
The agreement also standardizes procedures in real estate registries, contributing to municipal inspection. The possibility of this agreement was already provided for in the PDE and in more recent legislation on the subject.
The term provides that notaries inform the city hall about transactions involving units of the category whenever there is any change in the registration of the properties. In addition, retroactive information will be sent on operations with properties in the HIS and HMP categories in the last ten years.
The agreement also clarifies the moment at which the restrictions related to these units must be recorded in the corresponding title record certificates, in addition to detailing the documents that the buyer must present to register the acquisition of these properties.
The two updates represent important advances in relation to recent urban changes in São Paulo, clarifying doubts and fostering the development of HIS and HMP projects in the city.
